In order to further standardize the endorsement and administering of export certificate of EU textile, we specify the related regulations of administering proceedings about EU textile processing and trade in China and export to EU, certificate of original textile producing area as follows:

First, about processing and trade product exported to EU

1.According to the regulation of the double-sided agreements made by China and EU on textile and on silk hemp, if the textile is processed in China by Chinese enterprises and will be exported to EU up to the EU`s current regulations of exterior processing, it won't be restricted by the passive quota set by the double-sided agreements, just applying to the outward processing trade and tradable quota (OPT quota for short in the following) self-administered by EU. As to the again-import that meets the MOFTEC`s processing and trade regulations, EU will endorse the PRIOR AUTHORIZATION FOR ECONOMIC OUTWARD PROCESSING to EU importer in advance.

2. When Chinese enterprises export textile in the item of OPT quota, they shall apply to affiliated department vising textile export certificate for certificate of original producing area with the copy of PRIOR AUTHORIZATION FOR ECONOMIC OUTWARD PROCESSING (two copies) provided by importer and related export documents; the number of PRIOR AUTHORIZATION FOR ECONOMIC OUTWARD PROCESSING shall be indicated in column No. 9 of certificate of original producing area.

3.Visa department shall issue the certificate of original producing area for the export enterprises after checking the copy of PRIOR AUTHORIZATION FOR ECONOMIC OUTWARD PROCESSING provided by importer and related export documents. At the same time, visa department shall seal the badge of EU textile export certificate visa in one copy of the PRIOR AUTHORIZATION FOR ECONOMIC OUTWARD PROCESSING and send it back to the export enterprises; the other copy of the PRIOR AUTHORIZATION FOR ECONOMIC OUTWARD PROCESSING remained in visa department.

4. When export enterprises ask customs for the approval of exporting textile in the term of OPT quota, they shall put in the sealed copy of the PRIOR AUTHORIZATION FOR ECONOMIC OUTWARD PROCESSING and need not take the certificate of textile export The customs transacts the export clearance on the sealed copy of the PRIOR AUTHORIZATION FOR ECONOMIC OUTWARD PROCESSING.

Second, about certificate of original producing area

1. According to the double-sided agreements between China and EU, when Chinese enterprises export textile in the term of double-sided agreements to EU (including quota and non-quota), they shall distinguish different products either to apply to visa department for textile certificate of original producing area, or to apply to visa department that vise general beneficial certificate of original producing area for general beneficial certificate of original producing area or declared in invoices or other bills that products are originally made in China. The above two kinds of certificate of original producing area only are to be checked by EU customs at the time of import. If enterprises export textile in the term of OPT quota, they shall apply for textile export license at the same time.

2. When export enterprises ask our customs for approval of exporting textile to EU, the custom needn't check the certificate of original producing area, but need to check the textile export license for textile in the term of OPT quota.

Every branch of MOFTEC must inform concerned proceedings to local textile export enterprises in time. The following two documents cease to use on Transmitting MOFTEC's Notice of stopping using certificate of non-quota shipment kinds of ECC (S.G. [1995] No.22) issued by Supervising Department of GOC, and Notice on customs clearance for textile exported to EU (P.L. [2000] No.124) issued by policies and Law Department of GOC. If any of the previous documents differ from this notice, this one is the standards.
